EXECUTIVE ORDER 2018-04

AN ORDER REORGANIZING THE BARANGAY COUNCIL FOR THE


PROTECTION OF CHILDREN (BCPC)

WHEREAS, Section 17 of Republic Act 7160, also known as the Local Government
Code, mandates that the barangays shall endeavor to provide for an effective and
efficient provision of basic services and facilities which includes programs and
projects for children and youth welfare;

WHEREAS, Republic Act No. 7610 (Special Protection for Children Against Child
Abuse, Exploitation and Discrimination Act) provides for stronger deterrence and
special protection against child abuse, exploitation and discrimination, and its
corresponding penalties;

WHEREAS, Article 359 and 360 of the Civil Code of the Philippines provides that
“the government shall establish Councils for the Protection of Children.”;

WHEREAS, Article 87 of Presidential Decree (PD) 603 (Children and Youth Welfare
Code) states that, “every barangay council shall encourage the organization of a
Local Council for the Protection of Children (LCPC) and shall coordinate with the
Council for the Welfare of Children (CWC ) in drawing and implementing plans for
the promotion of child and youth welfare”.

WHEREAS, Section 15 of Republic Act 9344, also known as the Juvenile Justice
and Welfare Act of 2006, mandates the LGUs to establish Local Councils for the
Protection of Children and allocate one percent (1%) of their Internal Revenue
Allotment for strengthening and implementation of programs and projects of said
council;

WHEREAS, DILG Memorandum Circular 2002-121 dated August 5, 2002 enjoins all
Local Chief Executive to organize/ re-organize their respective Local Council for the
Protection of Children,

NOW THEREFORE, I, ANITA L. QUINTE, Punong Barangay of San Isidro, Lupon,


Davao Oriental, by virtue of the powers vested in me by law, do hereby order the
reorganization of Barangay Council for the Protection of Children to composed of the
following:

SECTION 1. COMPOSITION:

SECTION 2. DUTIES AND FUNCTIONS:


1. Foster education of every child:
2. Take steps to prevent juvenile delinquency and assist parents of children with
behavioral problems so that they can get expert advice;
3. Adopt measures for the health of children;
4. Conduct capability building projects to increase knowledge and skills in
handling children’s program;
5. Encourage the proper performance of the duties and responsibilities of
parents, and provide learning opportunities on the adequate rearing of
children and positive parent – child relationship;
6. Promote wholesome entertainment in the community, especially in movie
houses;
7. Prepare AWFP for children and recommend appropriations to the
Sanggunian;
8. Provide coordinative linkages with other agencies and institutions in the
planning, monitoring and evaluation of plans for children;
9. Establish and maintain database on children in the barangay;
10. Advocate for the establishment and maintenance of playgrounds, day care
center and other facilities necessary for child and youth development;
11. Advocate for the passage of barangay resolutions/ordinances responsive to
child – related issues ad concerns and ensure the inclusion of children’s
program in the executive agenda;
12. Protect and assist children in need of special protection (e.g. abandoned,
maltreated & dependents) and refer cases filed against child abusers to
proper agencies/institutions;
13. Monitor situational reports on children and prepare quarterly updates
including the implementation of children’s program and make
recommendations to the City/Municipal CPC for consideration and nationwide
application;
14. Perform such other functions and other child related laws especially in matters
of child and parent education, health, entertainment, etc.

SECTION 3. SECRETARIAT
The Secretariat shall be responsible for providing technical support,
documentation of proceedings, preparation of reports, and such other assistance as
may be required in the discharge of its functions. The Secretariat shall be composed
of the following:

SECTION 4. FUNDING. Upon recommendation of the BCPC, funding shall be


provided for programs/ projects/ activities on children and ensure that these are
implemented.

SECTION 5. MONITORING AND EVALUATION. Regular monitoring shall be


conducted to determine the functionality of the BCPC and find out their
accomplishments, including implementation problems and issues.

EFFECTIVITY: This Executive Order shall take effect immediately.
